Elder Law
and Estate Planning Team
Elder Law is the legal practice of
helping a client plan for a time when he or she needs
assistance managing his or her affairs. We carefully
listen to each client to develop a legal plan (supported
by documents) that protects their personal rights and
assets in anticipation of what will be an otherwise
challenging and confusing period. Examples of Elder Law
services include health and long-term care planning,
planning and drafting documents in anticipation of
physical and/or mental incapacity, insurance, including
long-term care insurance, housing issues, including
discrimination and home equity conversions (e.g. reverse
mortgages), age discrimination in employment, government
benefits for Medicare, Medicaid, Social Security, Social
Security Disability (SSDI), and Supplemental Security
Income (SSI), retirement issues, including benefits from
private and public plans, and distributions from
non-qualified plans, such as Individual Retirement
Accounts (IRA's), estate administration, including trust
administrations, probate and alternatives to probate,
such as conservatorships, guardianships.
Estate Planning is the legal practice of helping a
client to plan for the gathering, management and
distribution of their assets upon their death. Both the
Elder Law and Estate Planning practices are complicated
by laws relating to tax, legal rights of surviving
spouses and children, as well as other heirs,
beneficiaries and creditors, the prior health of the
decedent, as well as the family dynamic of the decedent
(i.e. children, divorce and re-marriage). Our team of
attorneys and staff is experienced in guiding clients
through these issues in order to clearly identify each
client's goals, and to develop a plan that efficiently
meets those goals.
Trust and
Estate Litigation Team
The trust and probate complex litigation team
at Spector Weir Hyjek LLP represents people engaged in
battles over assets usually following someone's death.
We represent heirs, beneficiaries, interested parties,
administrators, trustees and executors in a variety of
such disputes including complex trust and will contests,
claims of undue influence, elder abuse, fraud, and
breach of fiduciary obligations. We also handle complex
actions involving the interpretation of trusts, wills
and other estate planning documents, claims seeking the
appointment and removal of administrators, custodians,
conservators, executors and trustees, and actions to
recover assets allegedly wrongly taken.
